Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the AI Ad Generator website and services (the "Service") operated by AI Ad Generator ("we", "us", or "our"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or of legal age to form a binding contract in your jurisdiction, to use the Service. By using the Service you represent that you meet these requirements and that you are not barred under any applicable law from doing so.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access or use. We may suspend or terminate accounts that show signs of misuse, fraud, or that violate these Terms.

3. Subscription, Billing, and Credits

a. Subscription plans

The Service is offered on a paid subscription basis with monthly credits. Each subscription period auto-renews until cancelled. The current price and credit allocation are listed on the Pricing page.

b. Credits

Monthly credits reset at the start of each billing period and do not roll over. Credits purchased through topup packs do not expire while your subscription remains active. Credits have no cash value and are not redeemable for refunds except as stated in the Refund Policy.

c. Cancellation and refund

You may cancel your subscription at any time from the billing page. Cancellation takes effect at the end of the current billing period; you retain access until then. We do not offer prorated refunds for partial billing periods, except where required by applicable law.

d. Taxes

Subscription fees are exclusive of any taxes, levies, or duties imposed by taxing authorities, which you are responsible for paying.

4. Acceptable Use

You agree not to:

  • Use the Service to generate content that is unlawful, defamatory, harassing, threatening, deceptive, or that infringes the rights of any third party.
  • Submit ads or content you do not have the right to use, including content that infringes copyright, trademark, publicity, or privacy rights.
  • Generate content depicting real people without their consent, or content intended to impersonate, defraud, or mislead.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Probe, scan, or test the vulnerability of the Service, breach authentication, or interfere with other users' access.
  • Use the Service to build a competing product or to scrape model outputs at scale for redistribution.
  • Use the Service in violation of applicable laws, including export controls and sanctions.

5. Your Content

You retain ownership of the inputs you submit (source ad URLs and files, brand context, prompts) and of the outputs the Service generates for you (analyses, scripts, generated videos, subtitle files), to the extent such ownership is available under applicable law.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and process your inputs and outputs as necessary to provide and improve the Service, including sending them to the third-party AI processors described in our Privacy Policy.

You are solely responsible for ensuring that you have the rights to the source content you submit and that your use of any output complies with applicable advertising laws, platform policies (e.g. Meta and TikTok ad policies), and the rights of third parties.

6. AI-Generated Content

The Service uses third-party AI models to analyze ads and generate scripts and videos. Output is produced probabilistically and may contain errors, inaccuracies, hallucinated facts, biases, or content similar to other users' outputs. Output may not be original, may not be eligible for copyright in some jurisdictions, and may infringe third-party rights. We make no representation that any output is fit for a particular purpose. You are responsible for reviewing every output before using it commercially.

7. Our Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by us or our licensors and is protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, no rights are transferred.

8. Third-Party Services

The Service relies on third-party providers (listed in our Privacy Policy) and may contain links to third-party sites and services. Their use is governed by their own terms, and we are not responsible for their content or availability.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately if you breach these Terms, create risk or legal exposure for us or other users, or fail to pay fees when due. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (Sections 5, 6, 7, 10, 11, 12, 13, 14) will survive.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING OUT OF COURSE OF DEALING. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE OR FREE OF INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS.

12. Indemnification

You agree to indemnify and hold harmless AI Ad Generator and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your inputs or outputs, (c) your breach of these Terms, or (d) your violation of any law or third-party right.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing in this Section limits any non-waivable rights you may have under your local law.

14. Changes

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. For material changes we will provide reasonable notice. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
